Recurring Billing, Commitment, Freeze and Termination Terms

Binding Legal Agreement

Effective upon purchase or renewal of a Body Haus Lifestyle Club membership (the “Membership”). This Agreement governs recurring billing, commitment periods, plan changes, freezes and cancellation. It should be read together with all applicable club rules, waivers and service-specific policies.

1. Membership Options and Commitment

  • Committed Memberships may be offered in 4-, 8-, 12-session, or Unlimited monthly options, as identified at the time of purchase.

  • Each committed Membership has a minimum commitment period of either six (6) months or twelve (12) months, depending on the plan selected.

  • The Membership begins on the purchase or activation date shown in the member account or purchase confirmation.

  • Membership benefits, included services, booking limits and usage allowances are determined by the specific plan purchased and may differ by location.

2. Monthly Billing and Payment Authorization

  • Membership dues are billed monthly to the payment method on file on the member’s recurring billing date.

  • The member authorizes Body Haus Lifestyle Club to charge recurring dues and any properly disclosed fees to the payment method on file until the Membership is cancelled in accordance with this Agreement.

  • The billing date will generally remain the same each month unless adjusted by Body Haus Lifestyle Club with notice or as necessary because of calendar-date limitations, failed payments or account corrections.

  • The member is responsible for maintaining a valid payment method and promptly updating billing information.

3. Automatic Month-to-Month Renewal

  • After the initial six (6)- or twelve (12)-month commitment period ends, the Membership automatically continues on a month-to-month basis unless cancelled under Section 4.

  • The month-to-month Membership will continue at the member’s then-applicable monthly rate, subject to any advance notice required by applicable law for a rate change.

  • The month-to-month renewal does not create a new six (6)- or twelve (12)-month commitment unless the member affirmatively selects a new committed plan or changes plans under Section 7.

4. Cancellation After the Initial Commitment Period

  • After the initial commitment period has been completed, the member may cancel the month-to-month Membership by providing at least thirty (30) days’ written notice before the next billing date.

  • Cancellation requests must be emailed to hello@bodyhauslifestyleclub.com.

  • If notice is received fewer than thirty (30) days before the next billing date, the next scheduled monthly payment will be processed and the cancellation will take effect before the following billing date.

  • There is no separate $50 cancellation fee. The only cancellation charge that may apply is the early termination fee described in Section 5 when a member cancels before completing the initial commitment period.

  • Membership dues and other amounts already paid are nonrefundable except where required by applicable law. Membership access continues through the paid period unless otherwise stated in writing.

5. Early Termination During a Commitment Period

  • A member may request early termination before completing the initial commitment period by providing at least thirty (30) days’ written notice to hello@bodyhauslifestyleclub.com and paying the applicable early termination fee below.

Commitment Early Termination Fee 6-Month Plan One (1) month of the member’s monthly Membership rate. 12-Month Plan - request received during months 1-6 Two (2) months of the member’s monthly Membership rate. 12-Month Plan - request received during months 7-12 One (1) month of the member’s monthly Membership rate.

  • Timing rule. The applicable fee is determined by the date Body Haus Lifestyle Club receives the member’s written cancellation request, not the later effective cancellation date. For a twelve-month plan, requests received during membership months 1 through 6 are charged two months of the Membership rate; requests received during membership months 7 through 12 are charged one month of the Membership rate.

  • The Membership must be active or handled under an approved freeze arrangement when the request is submitted. A freeze does not eliminate an existing early termination obligation.

  • The cancellation becomes effective after the required notice period and payment of all amounts due, unless a different date is confirmed in writing by Body Haus Lifestyle Club.

6. Membership Freeze

  • A member may request one complimentary freeze of up to two (2) weeks during a Membership term, subject to approval and any location-specific procedures.

  • A longer freeze, when approved, is subject to a $50 monthly freeze fee unless waived in writing for a qualifying medical reason or as otherwise required by law.

  • Medical freeze requests may require reasonable supporting documentation from a licensed healthcare provider.

  • During an approved freeze, regular Membership access and benefits are suspended unless Body Haus Lifestyle Club confirms otherwise in writing.

  • The initial commitment end date is extended by the length of the approved freeze unless Body Haus Lifestyle Club expressly confirms otherwise in writing. A freeze therefore pauses, but does not satisfy or shorten, the minimum commitment period.

  • A member may submit a cancellation request while frozen. The notice will be recorded when received, but the member remains responsible for any applicable early termination fee and other amounts due. Body Haus Lifestyle Club may require the account to be brought current before the cancellation becomes effective.

  • Freeze requests and related documentation must be submitted to hello@bodyhauslifestyleclub.com before the requested freeze date whenever reasonably possible. Retroactive freezes are not guaranteed.

7. Plan Changes, Upgrades and Downgrades

  • A member may request an upgrade or downgrade by contacting the local club or emailing hello@bodyhauslifestyleclub.com.

  • Unless Body Haus Lifestyle Club confirms otherwise in writing, an approved plan change begins a new six (6)- or twelve (12)-month commitment based on the plan selected, effective on the date of the change.

  • Any prorated amount, credit or additional charge associated with a plan change will be disclosed or reflected in the member account.

8. Personal and Nontransferable Membership

  • Memberships are personal to the named member and may not be sold, assigned, shared or transferred to another individual unless Body Haus Lifestyle Club provides prior written approval.

9. Failed Payments and Account Status

  • If a payment is declined or reversed, Body Haus Lifestyle Club may retry the payment method, request an updated payment method, suspend Membership access and collect any amount lawfully due.

  • Suspension for nonpayment does not automatically cancel the Membership or eliminate the member’s remaining commitment or payment obligations.

10. Changes to Rates or Terms

  • Body Haus Lifestyle Club may change month-to-month rates, fees or these terms by providing any notice required by applicable law.

  • Material changes will not retroactively alter an earned early termination fee or shorten a prepaid access period, except where required by law or agreed to in writing.

11. Consumer Rights and Applicable Law

  • Nothing in this Agreement limits or waives any cancellation, refund, renewal-notice or other consumer right that cannot legally be waived under applicable federal, state or local law.

  • If applicable law gives the member a right that conflicts with this Agreement, the applicable law controls to the extent of the conflict.

  • Any legally required notice, cancellation form or refund will be provided or honored as required by applicable law.

12. Written Notices and Contact Information

  • All Membership cancellation, early termination, freeze and plan-change requests must be submitted in writing to hello@bodyhauslifestyleclub.com unless Body Haus Lifestyle Club provides another designated written channel.

  • A request is considered received when it reaches the designated email inbox. Members should retain a copy of the sent email and any confirmation received.

  • The member is responsible for keeping current contact information in the member account so that billing and renewal notices can be delivered.

13. Entire Agreement; Severability; No Waiver

  • This Agreement, the purchase confirmation, applicable Membership description, club rules and signed waivers form the agreement governing the Membership.

  • If any provision is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

  • A delay or failure by Body Haus Lifestyle Club to enforce a provision does not waive the right to enforce it later.

14. Member Acknowledgment

  • By purchasing, renewing or continuing to use a Membership, the member acknowledges that the member has reviewed and agrees to the recurring billing, commitment, freeze and cancellation terms described above, subject to all nonwaivable rights under applicable law.
